Ultra Digital VPN - Terms of Service

Welcome to Ultra Digital VPN. These Terms of Service ("Terms") govern your access to and use of the "Ultra Digital VPN" service (the "Service"), which is owned and operated by Ultra Digital Companies, LLC (hereinafter "the Company," "we," "us," or "our"). Our services are provided via access keys compatible with the Outline Client application. Please read these Terms carefully.

By purchasing a subscription and using a provided access key, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into this agreement. If you do not agree to these Terms, you may not use our Service.

1. Your Access Key

To use our Service, you must purchase a subscription, after which you will be provided with a unique access key. You are responsible for safeguarding this key and for all activities that occur using it. You must notify us immediately of any unauthorized use of your key. You agree that your access key is for your personal use and you will not share it with others.

2. Use of Third-Party Software (Outline Client)

Our Service requires the use of the "Outline Client" application, a third-party software developed and maintained by Jigsaw, a unit within Alphabet Inc.

  • Your Responsibility: You are responsible for downloading and installing the official Outline Client on your devices.
  • Disclaimer: We provide access to our servers through the Outline Client; we do not provide the client software itself. The Company is not responsible for the performance, security, or any bugs within the Outline Client application. Your use of the Outline Client is subject to its own terms and licenses.

3. Subscriptions & Payments

Our Service is offered on a subscription basis. All subscriptions are billed in advance on a recurring basis.

  • Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account management page or by contacting our support team.
  • Billing: You authorize us to charge your chosen payment method for the recurring subscription fees.
  • Price Changes: We reserve the right to change our subscription fees. Any price changes will be communicated to you in advance and will only take effect at the start of the next billing cycle.

4. Refund Policy: 30-Day Guarantee

We offer a 30-day money-back guarantee for initial orders. If you are not satisfied with our Service for any reason, you may request a full refund within 30 days of your purchase date. This guarantee applies only to your first purchase and does not apply to subscription renewals. Refunds are generally processed within seven (7) business days.

5. Prohibited Activities

Your privacy is our priority, but we do not condone illegal or malicious activities. By using our Service, you agree NOT to:

  • Use the Service for any illegal purpose, including but not limited to the transmission or distribution of illegal content.
  • Engage in spamming, phishing, or sending unsolicited emails.
  • Distribute malware, viruses, or any other malicious code.
  • Attempt to gain unauthorized access to any computer, network, or system (i.e., hacking).
  • Infringe upon the intellectual property rights of others, including copyright, patent, or trademark infringement.
  • Engage in harassment, defamation, threats, or any other activity that violates the legal rights of others.
  • Use the Service to conceal your identity for the purpose of committing illegal acts.

We reserve the right to terminate any account and revoke its associated access key for any violation of these rules, without a refund.

6. Our Commitment to Privacy & Data Handling

Your privacy is fundamental to our service. The underlying Outline technology we use is specifically designed to prevent the logging of user internet activity.

What We DO NOT Collect:

We never monitor, collect, or store logs of your browsing history, traffic content, DNS queries, or personal IP address.

Limited Data for Service Administration:

To maintain and improve our service, the Outline server software we use collects a minimal amount of non-identifiable data for administrative purposes. This includes data associated with your access key (like total data usage and last activity timestamp) and aggregated data at the server level (like general network provider information). 7. Service Availability and Quality

The Service is provided on an "as-is" and "as-available" basis. While we strive to provide a fast, reliable, and uninterrupted service, we do not guarantee that the Service will always be available or error-free. Connection speed and service performance may vary depending on your location, the servers you connect to, your internet service provider, and the performance of the Outline Client on your device.

8. Limitation of Liability

To the maximum extent permitted by law, Ultra Digital Companies, LLC, its affiliates, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service or your inability to use the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory.

9. Indemnification

You agree to defend, indemnify, and hold harmless Ultra Digital Companies, LLC, and its employees, directors, affiliates, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service, or your violation of these Terms.

10. Termination

We may terminate or suspend your service, which involves revoking your access key, immediately and without prior notice or liability, if you breach these Terms. You may cancel your subscription at any time. Upon termination, your access key will be disabled and your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website prior to the change becoming effective. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
